BUSINESS CONDITIONS (AGB)/ FEES

If you find an apartment or house through Markus Hengstler Immobilien, we will charge you commission based on the following conditions:

As soon as an oral or written rental contract is agreed to, a commission fee in the amount of 2 month's rent plus VAT immediately falls due. If the landlord has offered the property to Markus Hengstler Immobilien, for a rental period below 10 months, the commission is calculated according to the scale shown here, see also Fig. 4 (business conditions (AGB)).

Fuerthermore the following conditions of service apply:

1. Markus Hengstler Immobilien will supply the customer - either orally or in writing - with offers of rental properties which were previously unknown to him. Should the customer already have knowledge of an offer he must inform Markus Hengstler Immobilien immediately and if requested provide proof of his previous knowledge.

2. All offers from Markus Hengstler Immobilien must be treated confidentially. If this confidentiality is breached the customer is liable to Markus Hengstler Immobilien for the commission fee which would have been due.

3. Markus Hengstler Immobilien merely provides information about accomodation and the possibility of a rental contract. The obligations of the rental contract are soley the obligation of the client and the landlord. Markus Hengstler Immobilien cannot be held responsible to any of the parties for a violation or breach of the rental contract.

4. The finalisation of an oral or written rental contract for one of the offers given the client must be reported to Markus Hengstler Immobilien immediately, at the latest within 48 hours. The same applies for every extension of the rental contract.

The commission scale granted (see above) by Markus Hengstler Immobilien for rental contracts with a rental term of up to 10 months defines the partial maturity of the commission. This scale is not applicable and the entire commission falls due: a) If 14 days after the invoice is issued for the partial commission no payment has been received  b) If, after a rental contract has been concluded for property presented by Markus Hengstler Immobilien or the rental property has been handed over, stating rental price and intended or agreed rental term, the client fails to inform Markus Hengstler Immobilien thereof.

5. If the client finds accomodation from another source, he commits himself to report this to Markus Hengstler Immobilien and to advise Markus Hengstler Immobilien of his new address.

6. The commission is based on the monthly rent given by the landlord in our offer, including extra costs and the rental period agreed by the landlord and tenant.

7. No claims can be made against Markus Hengstler Immobilien in the case of an early termination of the rental contract. The full commission fee remains due according to the originally agreed rental contract.

8. Where the original agreed rental contract is extended, an additional charge is due in line with the table of  commission fee as stated above.

9. A commission fee will also be charged, if the landlord, to which you where referred by Markus Hengstler Immobilien, offers the latter a housing space different from that indicated by Markus Hengstler Immobilien. This is also vaild in case the landlord is not the owner of accomodation or suggests accomodation space in the name of third parties.

10. By using our services you are entering into a contract with us and agree to abide by our conditions of service.

11. In all other cases statutory provisions apply
